HIPAA after HITECH:
Top 5 issues for physician practices
The HITECH (Health Information Technology for Economic and Clinical Health) Act, passed as part of the 2009 economic stimulus bill, contains a number of important changes to Health Insurance Portability and Accountability Act (HIPAA) privacy and security requirements for physician practices. [See Pub. L. No. 111-5 (Feb. 17, 2009) (Title XIII of Division A; Title IV of Division B.] Breach notification changes will go into effect as early as September; most others will go into effect in February. FTC delays Red Flags Rule enforcement until Nov. 1
The Federal Trade Commission (FTC) has delayed the enforcement date of the Red Flags Rule until Nov. 1. This regulation requires creditors and financial institutions to develop identity theft-prevention programs. [Continued]
